Expungement: What Does it Mean?

“Man, I can’t believe I got a DWI over five years ago… I wonder if I can get that off my record?”

So, what can you do about it? Luckily, Arkansas allows its citizens to “seal” their criminal record after a period of time. “Seal” under the statute means to expunge, remove, and treat your record as confidential.


Now you may say, “Expungement! Yes, that is what I want. Wait, what does that actually mean?” Expungement means your criminal record is hidden from public view. However, certain people – in limited circumstances – can still see your record, including a prosecutor, law enforcement, a judge, the Arkansas Crime Information Center, and even some private background check companies.


The benefits of expungement is that your record is still hidden from most systems. In fact, as a matter of law, your criminal conduct did not occur, and you’re able to state that your conduct did not occur and that it does not exist on your record!
